Ohmisfortune Wholesale Agreement

Terms & Conditions

The following agreement outlines wholesale terms between Ohmisfortune® and approved retail partners. By placing an order or submitting an inquiry, buyer agrees to the terms below.

• • Pricing: $0.98 per individual Ohmisfortune Cookie; $12.50 per box (13 cookies per box).
• • Minimum order: ______ individual cookies or ______ boxes.
• • All cookies include signature Ohmisfortune® packaging and fortune sticker.
• • Branding, packaging, designs, and Ohmisfortunes may not be altered or reproduced without written consent.
• • Payment accepted via Cash / Check / Zelle / Stripe as agreed per order.
• • Optional display materials (signage/sample box) available upon request.
• • Seller may update pricing, packaging, or availability with prior notice.

Allergen Notice

Ohmisfortune Cookies are produced with or may come in contact with common allergens, including wheat (gluten), soy, eggs, and dairy. Products are prepared in a facility that also processes peanuts and tree nuts. Retailers are responsible for displaying appropriate allergen information to consumers and for preventing cross-contact once products are received.

Liability Statement

Upon delivery, buyer assumes responsibility for proper handling, storage, and display per standard food-safety practices. Except where prohibited by law, Ohmisfortune LLC shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, arising from resale, misuse, improper storage, or failure to disclose allergens. Seller’s total liability for any claim shall not exceed the purchase price paid for the affected products.

Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles. Venue for any dispute shall lie in the state or federal courts located in Texas.

Agreement Acceptance

By submitting an inquiry or purchase order, buyer confirms agreement to the Terms & Conditions, Allergen Notice, Liability Statement, and Governing Law provisions above. All Ohmisfortune® products, packaging, and brand assets are the intellectual property of Ohmisfortune LLC. All rights reserved.
